These Terms of Service ("Terms") govern your use of TabWall ("we", "us", "the platform"). By using TabWall, you agree to these Terms. If you do not agree, please do not use the platform.
These Terms apply to everyone who uses TabWall, including registered users, guest users, organisation owners, administrators, and event managers.
We have written these Terms in plain language so that everyone can understand them, regardless of their technical background.

Acceptance of Terms
By accessing or using TabWall, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
These Terms apply to all types of users:
- Registered Users — people who sign up with their email address
- Persistent Guests — people added to an organisation by name and face
- Event-Scoped Guests — people who join only for a single event
- Organisation Owners and Admins — people who manage organisations and their locations
- Event Admins and Managers — people who run events
If you do not agree to these Terms, you should not use TabWall.
Definitions
To help you understand these Terms, here are some key words we use:

| Registered User | A person with an email-based account on TabWall |
| Persistent Guest | A person added to an organisation by name and face, who can attend multiple events |
| Event-Scoped Guest | A person who joins a single event only — their data is removed when the event closes |
| Org Owner | The person who created and is responsible for an organisation |
| Org Admin | A person with administrative rights within an organisation |
| Event Admin | A person who manages a specific event |
| Wall Display | A screen (such as a TV or projector) that shows real-time consumption data at an event |
| Consumption | A record of a beverage served to a person at an event |
| Settlement | The process of balancing and closing out what people owe for their consumptions |
| Face Embedding | A mathematical representation of a person's face used for recognition (not a photo) |
| Biometric Data | Sensitive personal data derived from facial features, protected under EU law |
Role hierarchy: TabWall has three levels of roles:
- Global: Guest or Admin (platform-wide)
- Organisation: Owner, Admin, or Member (within a specific organisation)
- Event: Admin, Manager, or Member (within a specific event)
What TabWall Does
TabWall is a real-time consumption tracking platform designed for community events. It helps organisers manage:
- Member registration — signing up members and guests for events
- Consumption logging — recording what beverages are served, either manually or with optional face recognition
- Real-time tab displays — showing live consumption data on wall displays
- Settlement summaries — calculating what each person owes at the end of an event
- Event management tools — creating events, managing beverage menus, and setting prices
What TabWall Is Not
TabWall is not a certified billing system, point-of-sale system, or financial software. It is a tracking aid that helps organisers keep records during events. The organiser always retains ultimate responsibility for consumption tracking, payment collection, and dispute resolution.
Account Terms
Age Requirement
You must be at least 16 years old to use TabWall. This is the minimum age for data processing consent under EU law (GDPR).
Registration
- Registered Users sign up with their email address and receive a one-time login code (OTP) — there are no passwords
- Guests are added by an event organiser using their name and, if face recognition is enabled, their face
Your Responsibilities
- Provide accurate information when registering
- Keep access to your email address (you need it to log in)
- Do not share your login codes with others
- Only one account per email address is allowed
Account Suspension
We may suspend or terminate your account if you violate these Terms. We will explain the reason when possible.
Organisation Responsibilities
If you are an Organisation Owner or Admin, you have additional responsibilities:
Data Controller
Under EU data protection law (GDPR), your organisation is the data controller for the personal data of your members and guests. This means you are legally responsible for:
- How member data is collected and used within your organisation
- Ensuring that appropriate consent is obtained before biometric data (face recognition) is collected — TabWall provides the consent flows, but your organisation must ensure they are used
- Managing your members and their data responsibly
Event Management
As an organisation administrator, you are responsible for:
- Setting accurate beverage prices
- Managing events and ensuring timely settlement
- Resolving disputes about consumptions or payments between your members
- Reviewing and accepting the Data Processing Agreement
Internet Connectivity
Internet access at your event venue is your responsibility. TabWall does not provide, manage, or guarantee network connectivity. If the internet goes down at your venue, TabWall cannot function normally, and we are not responsible for any data that is lost or incomplete as a result.
User Obligations
All TabWall users agree to:
- Provide accurate information during registration and when using the platform
- Not share account access or one-time login codes with others
- Not circumvent consent flows — especially biometric consent for face recognition
- Not use the platform for illegal purposes of any kind
- Report security concerns — if you notice something wrong, please tell us promptly at privacy@tabwall.de
Acceptable Use
When using TabWall, you agree not to:
- Use automated tools to scrape, copy, or extract data from the platform
- Attempt to reverse-engineer, decompile, or extract the platform's source code
- Interfere with the platform's operation or disrupt other users' experience
- Upload malicious content (viruses, harmful scripts, etc.)
- Use bots or automated systems to access the platform
Service Limitations and Disclaimers
Please read this section carefully. It explains the limits of what TabWall can guarantee.
"As-Is" Service
TabWall is provided "as is" and "as available" without any warranty of any kind, whether express or implied. This means we do our best to provide a reliable service, but we cannot guarantee that it will always work perfectly.
No Uptime Guarantee
There is no Service Level Agreement (SLA). The platform may experience downtime for maintenance, updates, or unexpected issues. We will try to minimise disruptions, but we cannot promise uninterrupted service.
Accuracy of Records
We do not guarantee the accuracy, completeness, or reliability of consumption records. While we design TabWall to be as accurate as possible, technical issues can occur. The organiser should always verify consumption data independently when settling payments.
Internet Connectivity
Internet connectivity at the event venue is the venue's responsibility. TabWall has no control over and is not responsible for network availability at your location. If the connection drops, consumption records may be lost or incomplete.
Not a Billing System
TabWall is a consumption tracking aid — it is not a certified billing system, point-of-sale, or financial software. Settlement summaries are calculated aids, not invoices or financial documents. The organiser retains ultimate responsibility for:
- Tracking consumption accurately
- Settling payments with members
- Resolving any disputes
Technical Safeguards
Technical safeguards exist to help prevent data loss (such as Google Sheets fallback sync, admin panel access, and degraded offline mode for wall displays). However, these safeguards are not guaranteed to prevent all data loss or tracking errors.
Face Recognition
Face recognition is provided for convenience and may have accuracy limitations. Manual fallback is always available — no one is required to use face recognition.
Limitation of Liability
To the maximum extent permitted by applicable law:
- TabWall shall not be liable for any indirect, incidental, special, consequential, or punitive damages — this includes lost profits, lost data, or business interruption
- TabWall's total liability for any claims arising from your use of the platform shall not exceed the amount your organisation paid to TabWall in the 12 months before the claim arose, or EUR 100 for users on a free plan, whichever is greater
Specific Exclusions
TabWall is specifically not liable for:
- Loss of consumption data due to outages or technical issues
- Incorrect consumption records
- Incorrect settlement summaries or calculations
- Financial losses due to the platform being unavailable
- Losses caused by internet connectivity issues at the venue
- Any decisions made based on data from the platform
What This Does Not Affect
Nothing in these Terms excludes or limits our liability for things that cannot be excluded by law, such as:
- Gross negligence or intentional misconduct
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
Compensation for Losses
If your use of TabWall causes us to face legal claims, fines, or losses because you violated these Terms, you agree to compensate us for those reasonable costs and damages. This is sometimes called "indemnification."
In plain terms: if you break the rules and it costs us money, you agree to cover those costs.
Intellectual Property
What We Own
The TabWall platform — including its design, code, documentation, and branding — is owned by TabWall. You may not copy, modify, or distribute any part of the platform without our written permission.
What You Own
- Your personal data remains yours — see our Privacy Policy for details on how we handle it
- Organisation data (beverage catalogues, pricing, event configurations) belongs to the organisation that created it
License to Us
By using TabWall, you grant us a limited license to process your data as described in our Privacy Policy. This license is only for the purpose of providing and improving the platform.
Termination
Ending Your Use
- You can stop using TabWall at any time
- We may suspend or terminate accounts that violate these Terms
What Happens After Termination
When an account is terminated:
- User accounts are deactivated
- Organisation data is retained for the legally required period (for accounting and legal compliance)
- Event-scoped guest data is automatically deleted when the event closes, regardless of termination
- Persistent guest biometric data is deleted upon admin request or consent withdrawal
- Registered user biometric data is deleted upon user request or consent withdrawal
Clauses That Continue
Even after termination, the following sections continue to apply: Limitation of Liability, Compensation for Losses, Intellectual Property, and Dispute Resolution.
Circumstances Beyond Our Control
Neither you nor TabWall is responsible for failure to perform obligations under these Terms if that failure is caused by circumstances beyond reasonable control. This includes:
- Natural disasters (floods, earthquakes, storms)
- Pandemic or epidemic health emergencies
- Government actions, sanctions, or new regulations
- Internet infrastructure failures outside our control
- Power outages
- War, terrorism, or civil unrest
The affected party must notify the other as soon as reasonably possible.
Third-Party Services
TabWall integrates with external services to provide its features:
- Google Sheets — for optional data export and fallback sync
- Stripe — for subscription payment processing
We are not responsible for the availability, accuracy, or terms of these third-party services. When you interact with them, their own terms and privacy policies apply.

Dispute Resolution and Governing Law
Applicable Law
These Terms are governed by the laws of Germany, as TabWall is operated from the European Union.
Resolving Disputes
If you have a concern or dispute:
- First, try to resolve it through good-faith communication — contact us at privacy@tabwall.de
- If that does not work, disputes may be referred to the courts at the platform operator's registered seat in Jever, Germany
EU Online Dispute Resolution
For consumers in the European Union, the EU provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/.
Changes to These Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last reviewed" date at the top of this page
- For significant changes, we will notify registered users via the platform (and/or email)
- Your continued use of TabWall after being notified of changes means you accept the updated Terms
- If you disagree with the changes, you may stop using TabWall and close your account
